The presidence with cases like this is that your at fault no matter what the other driver was doing. Since you are making a lefthand turn across a lane of traffic it is your responsibility to make sure that no accident occurs. In a case we talked about in class (can't remember the citation), a guy making a lefthand turn was hit by a teenage going way over the speed limit. The place were the guy was making the turn was at the base of a hill, so he didn't see the teenage until it was too late. Anyway, the judge ruled that even though the teenage was speeding it was the responsibility of the guy making the turn to make sure it was safe. I think that it when to a Supreme Court (probably a state one, not the US).
: I'm traveling in my 99 Z3 2.8 through a neighborhood heading westbound. I stop at a stop sign to make a left to go south. I check my right side and everything is clear. I check my left and it looks clear(there is a bush kinda obstructing the view). So I proceed to make a left. When I got past the bush, I see two cars coming, so I speed up and almost complete the left turn. I got hit on the driver's side rear end area, only putting a dent in the panel along with taking off the bumper and bending the left rear wheel.
: What really ticks me off is that:
: The street I'm making a left on is only one way traffic north and south bound, yet there were two cars traveling north bound in one lane.
: This guy had enough time to slow down to let me complete my turn, but didn't slow down until he hit me. I'm thinking he saw my car and just wanted to get some money out of me(he was driving an 80's Toyota).
: Can I do anything about this?
: I know the accident was my fault, but this guy could have avoid this if he would have slowed down.
